These Terms and Conditions ("Terms") govern your use of the website kickedoutofthesky.com (the "Site") and any purchases made through the Site. The Site is operated by Let Go Media , a company registered in Nevada, USA.

Let Go Media distributes music for the band "Kicked Out of the Sky" and operates the band's official website and merchandise store.

2. Acceptance of Terms

By accessing or using the Site, or by making a purchase through the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.

3. Eligibility

You must be at least 18 years of age to make a purchase through the Site. If you are under 18, you may only make purchases with the involvement and consent of a parent or legal guardian.

4. Account Responsibilities

The Site does not currently require account registration. If account functionality is added in the future, you will be responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Products and Pricing

• All merchandise prices are listed in US Dollars (USD)
• Prices are subject to change without prior notice
• We make every effort to display accurate product descriptions and images; however, slight color variations may occur between screen display and the printed product
• Product availability is not guaranteed and items may be discontinued at any time

6. Order Process

When you place an order through the Site:

1. You select your desired merchandise, size, and color
2. You proceed to checkout and provide shipping and payment information
3. Payment is processed securely via Stripe
4. Your order is sent to Printful, our print-on-demand partner, for production
5. Printful produces your custom merchandise and ships it directly to you
6. You receive order confirmation and tracking information via email

An order confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability or suspected fraud.

7. Payment Terms

• All payments are processed securely through Stripe
• We accept major credit cards, debit cards, and other payment methods supported by Stripe
• Payment is collected at the time of order placement
• We do not store your payment card details; all payment data is handled directly by Stripe in compliance with PCI-DSS standards

8. Intellectual Property

All content on the Site — including but not limited to music, lyrics, recordings, album artwork, merchandise designs, the band name "Kicked Out of the Sky", logos, photographs, videos, website design, and text — is the property of Let Go Media and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without prior written permission from Let Go Media.

9. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site or its systems
• Interfere with or disrupt the Site's functionality

• Use the Site to transmit malware, spam, or otherwise harmful content

In no event shall Let Go Media's total liability exceed the amount you paid for the specific product giving rise to the claim.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Site shall first be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in the State of Nevada, USA, in accordance with applicable arbitration rules. Each party shall bear its own costs of arbitration.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
