1. Introduction

These Terms and Conditions ("Terms") govern your use of kickedoutofthesky.com (the "Site") and any purchases made through it. The Site and merchandise store are owned and operated by Let Go Media, a Nevada, USA company ("we," "us"). Let Go Media manages and distributes the music of Kicked Out Of The Sky under arrangement with the artist, Matthew Bachman.

2. Acceptance of Terms

By accessing or using the Site, or by making a purchase through the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.

3. Eligibility

You must be at least 18 years of age to make a purchase through the Site. If you are under 18, you may only make purchases with the involvement and consent of a parent or legal guardian.

4. Account Responsibilities

The Site does not currently require account registration. If account functionality is added in the future, you will be responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Products and Pricing

All merchandise prices are listed in US Dollars (USD)
Prices are subject to change without prior notice
We make every effort to display accurate product descriptions and images; however, slight color variations may occur between screen display and the printed product
Product availability is not guaranteed and items may be discontinued at any time

6. Order Process

When you place an order through the Site:

You select your desired merchandise, size, and color
You proceed to checkout and provide shipping and payment information
Payment is processed securely via Stripe
Your order is sent to Printful, our print-on-demand partner, for production
Printful produces your custom merchandise and ships it directly to you
You receive order confirmation and tracking information via email

An order confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability or suspected fraud.

7. Payment Terms

All payments are processed securely through Stripe
We accept major credit cards, debit cards, and other payment methods supported by Stripe
Payment is collected at the time of order placement
We do not store your payment card details; all payment data is handled directly by Stripe in compliance with PCI-DSS standards

8. Intellectual Property

Music. All musical compositions and lyrics by Kicked Out Of The Sky are owned by Matthew Bachman and published by Tight Box Publishing. All sound recordings (masters) are owned by Matthew Bachman. Let Go Media distributes this music under license from Matthew Bachman. All rights reserved.

Band name and logos. "Kicked Out Of The Sky," the star logo and related marks are trademarks of Matthew Bachman. They are used on the Site and merchandise under license.

Artwork, designs and Site content. Album and single artwork, merchandise designs, product photography, and the website's design, text and code are owned by Let Go Media.

You may not reproduce, distribute, modify, create derivative works from, publicly perform or commercially exploit any of this content without prior written permission from the relevant rights holder. Requests can be sent to christa@letgomedia.com.

9. User Conduct

You agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site or its systems
Interfere with or disrupt the Site's functionality
Submit false, misleading, or fraudulent information
Reproduce, scrape, or harvest content from the Site without permission
Use the Site to transmit malware, spam, or otherwise harmful content

10. Limitation of Liability

To the fullest extent permitted by law, Let Go Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any purchases made through the Site.

In no event shall Let Go Media's total liability exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of your country of residence.

11. Disclaimer of Warranties

The Site and all merchandise are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the extent permitted by law. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms limits any rights you have under the mandatory consumer protection laws of your country of residence.

12. Indemnification

You agree to indemnify, defend, and hold harmless Let Go Media, Matthew Bachman, Tight Box Publishing, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to its conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Site shall first be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in the State of Nevada, USA, in accordance with applicable arbitration rules. Each party shall bear its own costs of arbitration.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
